Preface

In the preparation of this fifth edition, my main aim has remained that of presenting

the subject of Commonwealth Caribbean real property law in a manner accessible

to students, which demonstrates the application of legal principles in a modern and

practical context. Although designed primarily for students of real property, includ-

ing conveyancing and landlord and tenant law, it is hoped that practitioners also will

continue to derive benefit from the citation and analysis of local statutes and case

law. Since the publication of the previous edition, there have been several significant

and interesting decisions handed down by the superior courts of the various jurisdic-

tions in the region, and these are discussed in the text.

A new feature of this edition is the appendix of questions and answers, which

are intended as a guide for students sitting examinations in Caribbean real property

law in institutions of higher learning in the region. The ‘suggested answers’ are not

intended to be definitive, and indeed any answer to a legal problem is bound to be

based on the opinions and style of the particular commentator, so the concept of a

‘model’ or ‘definitive’ answer hardly exists in this context. Nonetheless, it is hoped

that students will derive some real benefit from this section of the book.
